1Introduction and acceptance
1.1These Terms govern your access to our website, applications, account, wallets, trading features, customer support and other services we make available to you (together, the "Platform" and "Services").
1.2By creating an account, accepting these Terms or using a Service, you agree to these Terms and the policies incorporated by reference in Section 1.4. If you do not agree, do not use the Services.
1.3If you use the Services for a legal entity, you confirm that you are authorised to bind it. "You" includes that entity where applicable.
1.4The following documents form part of your agreement only when they are published, linked at the relevant point of use and applicable to the Service you use: the Privacy Policy, AML/KYC Policy, Cybersecurity and Cyber Law Policy, Risk Disclosure, Fee Schedule, Trading Rules, Deposit and Withdrawal Rules, P2P Rules, Futures Rules, Earn Product Terms, Referral Rules and any clearly identified promotion-specific terms. If a product-specific document conflicts with these Terms, it controls for that product to the extent of the conflict, unless mandatory law requires otherwise.
1.5A feature shown in navigation, marketing or a test environment is not a commitment that it is available to you. We may limit products, assets, networks, order types and payment methods by account, jurisdiction, risk level or operational status. We will not represent a disabled or test feature as ready for live use.
1.6We provide these Terms, applicable product rules, risk information and fees in a form you can retain. Product-specific terms govern only a service you use. Mandatory law prevails over a conflicting term; otherwise, the more specific product term controls for that product as described in Section 1.4.
1.7NeviX operates its compliance programme with reference to applicable Malaysian laws and regulatory guidance, including anti-money-laundering requirements and the digital-asset framework administered by the Securities Commission Malaysia under the Capital Markets and Services Act 2007. Nothing in these Terms means that any Service is licensed, registered, recognised, approved or supervised as a banking, payment, securities, recognised-market or investment-management activity. Availability and any activity-specific authorisation must be assessed for the Service and jurisdiction concerned.
2Definitions
- Account: your NEVIX user account, including any enabled subaccounts.
- Digital Asset: a supported cryptocurrency, token or other digital unit shown as available on the Platform.
- Fiat: government-issued currency supported by an authorised payment method.
- Wallet Balance: our record of assets credited, available, reserved or otherwise allocated to your account. A displayed balance is not itself a blockchain address or proof of segregated on-chain ownership.
- Order: an instruction to buy, sell, convert or otherwise transact in a supported asset.
- Execution/Fill: a completed portion of an Order, recorded with its own identifier, quantity, price, fee and time.
- P2P Order: an order between users under the separate P2P Rules, which explain our role and any escrow arrangement.
- Third-Party Provider: a bank, payment service provider, blockchain network, liquidity provider, custody provider or other external service identified for a relevant transaction. We disclose the role of a material provider accurately.
- Available Balance: the portion of a Wallet Balance currently available for an eligible instruction, excluding amounts reserved, pending, locked or allocated to another product.
- Instruction: a request submitted through an authorised account channel, including an Order, withdrawal, transfer, conversion, subscription or cancellation.
- Operation ID: a unique reference assigned to an account-level operation so that its status and related ledger entries can be traced.
- Product Terms: the terms, rules and disclosures that apply to a specific Service and are presented or linked before you use it.
- Supported Network: the blockchain or payment rail we identify for a particular deposit or withdrawal at the relevant time.
3Eligibility and restricted use
3.1You must be at least 18 years old, legally capable of contracting, and permitted by applicable law to use the specific Services in your location. We may require a higher age or additional eligibility for some products.
3.2You must not use the Services if you are in a restricted jurisdiction, subject to applicable sanctions, acting for a prohibited person, or otherwise barred by law. Availability and any geographic restrictions are shown in the Platform or communicated by support. Do not use a VPN or inaccurate information to bypass restrictions.
3.3We may decline registration or restrict a Service where we cannot complete identity checks, assess source of funds, comply with law or manage risk. We will explain the reason where lawful and reasonably possible.
3.4Unless we expressly enable subaccounts or additional accounts, you may maintain only one personal Account. A permitted subaccount remains under the responsibility and verification of its parent Account. You may not lend, sell or share an Account.
3.5You may use an Account only for yourself or the legal entity identified and verified for it. You must not act as an undisclosed intermediary, nominee or money transmitter, or allow an unverified person to direct activity through your Account.
3.6Eligibility for one Service does not establish eligibility for another. We may apply product-specific knowledge, experience, location, verification, balance, risk or legal requirements before enabling P2P, futures, Earn or another feature.
3.7You must notify us if your residence, legal capacity, beneficial ownership, authority or another fact relevant to eligibility changes. We may require renewed verification before continued use.
4Registration, verification and security
4.1Provide accurate, complete and current information. You must promptly update material changes and provide documents reasonably needed for identity verification, fraud prevention, sanctions screening, tax reporting or other legal obligations.
4.2We may verify identity, beneficial ownership, residence, payment method ownership and source of funds or wealth before or after account activation, and periodically thereafter. Verification approval does not guarantee continued access to every Service.
4.3Keep your password, devices, email account, authentication factors and recovery methods secure. Use available security controls and notify us immediately at security@nevix.com if you suspect unauthorised access or an incorrect transaction.
4.4We may use email, authenticator apps, SMS, passkeys or other supported methods for authentication. Available methods, recovery steps and the consequences of losing access are explained in the Security Centre. We may impose a withdrawal or transfer hold after a security-sensitive account change, with notice where lawful.
4.5We will investigate a promptly reported unauthorised transaction. These Terms do not automatically make you responsible for every action taken through a compromised Account, and do not remove any mandatory consumer or payment rights. Responsibility will depend on the facts and applicable law.
4.6If offered, active-device and session-management tools allow you to review and revoke sessions. A revoke request may not cancel a transaction already completed. An emergency freeze may restrict trading, transfers and withdrawals until verification is complete.
4.7Instructions submitted after successful authentication are treated as originating from your Account for operational purposes, but this does not prevent investigation of compromise, system failure or mandatory legal rights. Review confirmations promptly and report activity you do not recognise.
4.8Account recovery requires sufficient evidence that you control the verified Account. We may impose additional checks and a temporary withdrawal restriction after recovery or a material security change to protect against takeover.
4.9We will not ask you through unsolicited communication to reveal a password, private key, seed phrase or one-time authentication code. You are responsible for checking the domain and official channel before acting on a message claiming to be from us.
4.10If you create or use an API key, you are responsible for its permissions, storage and authorised applications. Restrict permissions and network access where available, and revoke a key immediately if compromise is suspected.
5Asset holding, balances and service model
5.1NeviX, operating NeviX Exchange, holds customer digital assets credited on NeviX and records each customer's claims and transactions on our internal ledger. A displayed balance does not, by itself, establish that an individually segregated on-chain address or bank account exists for you. We disclose whether assets are pooled or segregated, and the identity and role of any material bank, payment or other custody provider, in the relevant product or transaction information before you use the affected service.
5.2We maintain a ledger of your credited, available, reserved, pending and product-allocated balances. Available balance may be reduced when an Order, withdrawal, P2P escrow or other authorised transaction reserves assets. A reserved balance is not available for other uses until released or settled.
5.3A blockchain transaction, internal ledger transfer and exchange trade are different events. An internal transfer does not necessarily involve an on-chain transfer; an on-chain deposit is not available for trading until the required confirmations and compliance checks complete.
5.4We will make transaction identifiers, balance changes and status information available in the Account as described in the applicable product rules. If a displayed balance conflicts with our authoritative ledger, we will investigate and correct it under Section 17; we will not treat a false success message as proof of settlement.
5.5We will not lend, stake, pledge or otherwise deploy assets in a yield-bearing product unless the product's terms explain that use and you opt in, except as otherwise permitted by an accurately disclosed custody arrangement and applicable law.
5.6Ledger records distinguish credits, debits, reservations, releases, fees and adjustments. We maintain an auditable reference for a manual or automated balance change and investigate an inconsistency using the authoritative transaction records.
5.7An estimated fiat or reference-currency value is informational and can change with price and exchange-rate data. It is not a promise that you can sell or withdraw the asset for that amount.
5.8We may reconcile balances after a network reorganisation, provider correction, duplicate credit, chargeback or confirmed system error. A correction must have a documented basis and is subject to the complaint route in Section 17.
5.9A negative balance or amount lawfully due may restrict withdrawal or use. We will identify the basis and relevant transaction records, and we will not convert or deduct another asset without authority under the applicable terms and law.
6Spot trading and order execution
6.1NeviX manages its spot order book, matching and execution for eligible users on enabled trading pairs. The live order-entry screen and Trading Rules specify minimum amount, tick size, quantity step, price bands, available order types, fees and market status.
6.2A Limit Order seeks execution at the specified price or a better price. It may remain open, execute partly, or never execute. A Market Order seeks prompt execution against available liquidity and may fill at multiple prices or only partly, subject to any disclosed protection limits. A Stop-Limit Order becomes eligible for placement when its stop condition is met; triggering does not guarantee execution.
6.3When you submit an Order, you authorise us to reserve the required asset and applicable estimated fee. We may reject an Order that fails balance, minimum, price, precision, risk, compliance, market-status or technical checks. We will provide a meaningful error where possible.
6.4An Order is not executed merely because a submission screen says it was accepted. A Fill is final when recorded by the authoritative trading system, subject to the error-correction and legal provisions below. The exact execution price and quantity-not the order-entry estimate-determine settlement and fees.
6.5An open Order may be cancelled to the extent not already filled. A cancellation request does not guarantee cancellation before a competing Fill. We will show the final status and release the unused reserve once cancellation is confirmed. The procedure for cancelling all open Orders, if offered, is stated in the Trading Rules.
6.6We explain NeviX's matching priority, platform-managed liquidity, self-trade prevention, partial fills, exceptional market conditions and erroneous trades in the Trading Rules. If an external venue is ever used for execution, we will identify its role before the affected service is used and update the applicable rules rather than describing it as NeviX-only execution.
6.7You must not engage in wash trading, self-trading designed to create artificial activity, spoofing, layering, market manipulation, abusive latency strategies or use of a malfunction. We may reject or cancel affected Orders and investigate under Section 15.
6.8We may halt a pair, reject new Orders or cancel open Orders where needed for security, market integrity, compliance or system stability. We will disclose material restrictions through the Platform or another available notice channel where practical.
6.9Your order history and execution history serve different purposes. An Order can have several Fills at different prices, times and fee rates. We make the order identifier, each execution identifier, executed and remaining quantity, fee, status and cancellation outcome available so you can reconcile the trade against your balance. A partial Fill does not extinguish the remainder unless the Order is cancelled or expires under its terms.
6.10Matching priority and eligible liquidity determine whether an Order fills; submitting first does not guarantee execution if the Order is not marketable or another rule applies. We disclose the matching approach in the Trading Rules.
6.11Self-trade prevention, if enabled, may cancel or reduce one or more Orders from accounts treated as related. It is a market-integrity control and does not replace your obligation not to engage in wash trading or manipulation.
6.12If an Order would reserve more than your Available Balance, exceed a limit or violate a price, size or precision rule, we may reject it rather than partly submit it, unless the applicable order type expressly supports a different treatment.
6.13We calculate settlement and fees from completed Fills. Open, rejected, expired and cancelled quantities do not constitute completed trades, though a separate disclosed product or external charge may apply.
6.14We may use market data from external exchanges as an input to reference prices and platform liquidity controls. A market-data connection alone does not route your Order to that exchange or place your NeviX-held assets in its custody. Displayed prices are not a guarantee of the price or liquidity available when your Order executes on NeviX.
7Convert
7.1Convert provides a quoted exchange of one supported asset for another. We show the input asset and amount, output asset and amount, applicable rate, any separately charged fee and the quote's validity period before you confirm.
7.2A quote may include a spread even if no separate trading fee is charged. We will not describe Convert as "free" without also explaining the rate and spread. We provide a refreshed quote if the previous quote expires before acceptance.
7.3We show the confirmed transaction and final credited amount in conversion history with an operation identifier. If we cannot honour a quote, we will not mark it successful and will release any reserved amount.
7.4When you accept a valid quote, you authorise the stated input debit and output credit. The completed conversion is normally final and is not reversed because the market rate later changes.
7.5A reference market price may differ from the Convert quote because of spread, size, liquidity, timing and operational costs. Compare the final input and output rather than relying only on a chart.
7.6If conversion status, balances and history conflict, contact support before repeating the instruction. We reconcile the operation under Section 17 and the Refund Policy.
8Deposits, withdrawals and internal transfers
8.1Deposit and withdrawal availability varies by asset, network, location, payment provider, verification level and account status. You must use the exact supported asset, network, address and required memo/tag. Transfers sent to an unsupported destination or network may be irrecoverable.
8.2A deposit is credited only after the required blockchain confirmations or fiat-provider settlement and any compliance review. We may apply published minimums and handling rules for unsupported or incorrectly routed deposits.
8.3Before you confirm a withdrawal, we will display the destination, network, amount, applicable network and NEVIX fees, minimum, estimated received amount and any required authentication. Fees may vary by network conditions; we will show the applicable fee before final confirmation.
8.4We may hold, reject or review a withdrawal for security, sanctions, fraud, legal process, network maintenance or a reasonable discrepancy. We will provide status updates unless prohibited by law. Once broadcast to a blockchain, a withdrawal generally cannot be reversed.
8.5Transfers between your own NEVIX wallet categories, or to another NEVIX user if offered, are internal ledger movements unless we identify them as on-chain. Before confirmation, we show the source, destination, asset, amount and any fee. We provide a receipt for a completed transfer and record the corresponding balance changes.
8.6A saved withdrawal address or address allowlist is a security convenience, not a guarantee that an address is safe. We may block a destination, network, asset or Account when required by law or based on documented risk controls. We describe any user-enabled allowlist and cooling period before activation.
8.7We distinguish a pending instruction, an internal ledger entry, a payment-provider settlement and a blockchain broadcast in the relevant transaction history. If we reject an instruction before settlement, we release any unused reservation. If an external transfer cannot be reversed, our receipt and support response identify the available reference and the limits of recovery.
9P2P trading
9.1If enabled for your Account, P2P allows eligible users to publish advertisements or trade with other eligible users under the separate P2P Rules. We explain our role and any provider involved in escrow or payments in those Rules.
9.2We explain advertisement requirements, available payment methods, payment-name matching, transaction limits, crypto reservation or escrow, payment windows, proof of payment, release authorisation, cancellation, appeals, fraud controls and fees in the P2P Rules.
9.3A "Paid" button or screenshot is not proof that fiat payment was received. A seller must verify receipt in their own payment account before releasing crypto. Users must not move conversation or payment outside the prescribed order flow to avoid protections.
9.4An appeal may result in a temporary hold while evidence is reviewed. We will maintain an auditable decision record and provide a reasonable opportunity for each party to present evidence, subject to law and urgent fraud prevention.
9.5We may suspend P2P advertisements and orders when the escrow, payment or appeal controls needed for safe operation are unavailable.
9.6Each party must use their own verified account and an approved payment method. A payment from an unrelated third party, split payment or request to communicate outside the order may be rejected or escalated.
9.7The advertiser is responsible for accurate price, limits, availability and lawful payment instructions. We may remove an advertisement that is misleading, abusive, unavailable or inconsistent with the P2P Rules.
9.8Cancellation does not reverse a fiat payment already made. If payment has been sent, use the appeal process and preserve the payment reference before agreeing to any return.
9.9Escrow or reservation reduces premature release risk but does not make us a party to the external fiat payment or guarantee that a bank transfer cannot be reversed or frozen.
10Derivatives and Futures
10.1Futures are leveraged, high-risk products. Losses may exceed the initial margin where allowed by the contract and applicable law. Futures are not suitable for every user. Before you trade an enabled futures product, we provide its contract terms, margin mode, leverage, mark/index price, funding, liquidation, insurance and auto-deleveraging mechanisms, fees and position limits.
10.2Funding payments on perpetual contracts, where applicable, are distinct from NEVIX trading commissions. Their direction and amount depend on the disclosed formula and settlement time.
10.3We may close, reduce or liquidate positions in accordance with published risk rules. We enable trading only where the applicable contract and its order, balance, position and risk controls are available. Display of an unsupported contract does not make it tradable.
10.4Nothing in these Terms gives us an undisclosed right to create a derivative, alter your position or charge an undisclosed liquidation fee.
10.5Margin requirements, maintenance margin and liquidation thresholds can change according to the disclosed risk rules. You are responsible for monitoring positions and maintaining sufficient eligible margin; a warning is not guaranteed before liquidation.
10.6Cross-margin can place a broader eligible balance at risk, while isolated margin limits risk to the allocated amount subject to contract rules. The selected mode and available controls are shown before or during position management.
10.7Mark price or another stated reference, rather than last-traded price, may determine unrealised profit and loss and liquidation. Index disruption and exceptional market rules are handled under the applicable futures rules.
10.8Funding can be paid or received at stated intervals and is separate from our commission. Closing immediately before or after the funding time can affect whether funding applies under the product rules.
10.9Futures availability does not mean the product is suitable for you. We may require an acknowledgement, knowledge check or additional eligibility assessment where appropriate or legally required.
11Earn, staking and automated products
11.1Before you subscribe to an enabled Earn, staking or automated product, we provide separate terms for acceptance. They identify the provider and use of assets, whether principal is at risk, reward source and calculation, fees, lock period, redemption rights and delays, counterparty and protocol risks, and what happens on suspension or insolvency.
11.2Any displayed APR, APY, multiplier, historical return or AI-generated forecast is not a guarantee. We will not market a return as fixed or risk-free unless the product's legal terms and actual economics support that claim.
11.3Automated trading operates only within parameters you authorise. You remain able to review activity and disable the feature in accordance with its terms. We disclose material information about model performance, fees, drawdown and conflicts of interest before activation.
11.4Subscription can move assets from Available Balance into a product allocation and redemption can require a stated processing or lock period. We show status and do not represent an initiated redemption as complete before settlement.
11.5Rewards can vary, accrue in another asset, be subject to validator or protocol rules, or be reduced by slashing, fees or early redemption. A displayed annualised rate is not a promise of the amount you will receive.
11.6Disabling an automated tool stops future eligible activity according to its rules but does not reverse trades already executed or remove existing market exposure. You remain responsible for reviewing open Orders and positions.
11.7If a protocol, validator, data source or other material provider fails, we may suspend subscription or redemption while protecting records and assessing available recovery. The product terms explain how the risk is allocated.
12Referrals, rewards and promotions
12.1A referral or reward is available only under a published programme's eligibility rules, start/end dates, qualifying actions, calculation, payment timing, caps and exclusions. A banner or referral link alone does not create an unconditional entitlement.
12.2We may withhold, reverse or recover rewards generated by duplicate, related-party, fake, self-referred, abusive or non-compliant Accounts, after reasonable review and notice where practicable.
12.3We may change or end a programme prospectively on notice. We will not retroactively remove an earned reward without a stated rule, legal requirement, fraud finding or error-correction basis.
12.4We specify whether a reward is cash, a Digital Asset, fee rebate, voucher, trial balance or another benefit and whether it can be withdrawn, expires or requires further activity.
12.5Taxes, market value changes and eligibility restrictions can affect the value of a reward. A promotional value is not guaranteed until the benefit is credited and its conditions are satisfied.
12.6Participants must not create duplicate identities, coordinate sham transactions, manipulate volume or mislead another person to qualify. We preserve the basis for a withholding or reversal and provide a complaint route.
13Fees, taxes and statements
13.1The Fees and Charges Policy explains how we disclose fees. We show current rates for each enabled Service and, where relevant, pair, asset, network, region and customer tier on the live fee schedule or transaction preview before you commit. We show estimated fees before an Order or transfer and the actual fee on the receipt or history after execution.
13.2We charge trading fees on executed quantities, including each partial Fill, and not on an entirely unfilled or cancelled Order. We identify funding, blockchain network costs, payment-provider charges, spreads, taxes and our commissions separately when applicable.
13.3We may change fees prospectively with reasonable notice, except where an external network cost changes dynamically and is disclosed at confirmation. A change will not retroactively alter an already completed transaction.
13.4You are responsible for determining your tax obligations, subject to any withholding, collection, reporting or disclosure that applicable law requires us to perform. We will provide reasonably accessible transaction records; we do not provide individual tax advice.
13.5By confirming a transaction, you authorise deduction of the fee and tax shown for that transaction from the indicated balance or proceeds. A deduction from another asset requires a disclosed conversion or other authority under the applicable terms.
13.6Fee calculations use actual execution values, applicable rates and disclosed precision. If an Order has multiple Fills, fees can be calculated separately for each Fill and then reflected in the Order summary.
13.7Statements and downloadable histories are provided for convenience and reconciliation. You should review them and report an apparent error promptly; they are not individual accounting or tax advice.
13.8If law requires withholding or reporting, we may request tax information, deduct the required amount and provide available documentation. We do not classify a statutory withholding as our service fee.
14Customer conduct and restrictions
14.1Do not use the Services for money laundering, terrorist financing, sanctions evasion, fraud, illegal goods, unauthorised remittances, manipulation, harassment, or any other unlawful activity.
14.2Do not submit false identity or payment data; impersonate another person; use another person's funds or payment method without authority; exploit a bug; interfere with our systems; scrape or overload the Platform; or attempt unauthorised access.
14.3Report suspected vulnerabilities to security@nevix.com. Do not exploit a vulnerability or access another user's data. This does not prohibit lawful security research or rights that cannot be restricted by contract.
14.4You must not use the Services in a way that violates third-party intellectual-property, privacy or other legal rights.
14.5You must not use automated access except through an authorised interface and within published limits. Do not circumvent rate limits, security controls, geographic restrictions, verification, product eligibility or market safeguards.
14.6You must not create misleading advertisements, send abusive or fraudulent communications, solicit off-platform P2P activity, or request another user's credentials or confidential information.
14.7If you discover an error, duplicate credit or vulnerability, stop exploiting it and report it promptly. Use or withdrawal of value you know was credited by mistake may result in restriction, recovery and lawful action.
14.8We may preserve and review relevant activity when investigating a suspected breach. Enforcement is proportionate to the conduct, risk, legal obligations and available evidence, and is subject to the review route in these Terms.
15Monitoring, compliance holds and account restrictions
15.1We may monitor transactions and request information reasonably needed for legal compliance, security, fraud prevention and market integrity, subject to our Privacy Policy and applicable law.
15.2We may delay, reject, restrict, freeze or reverse an instruction to the extent permitted by law where we reasonably suspect fraud, sanctions exposure, compromised credentials, a serious rule violation, an erroneous credit, or a legal order. We will document the reason and duration internally and notify you where lawful and practicable.
15.3We will review restrictions and keep them proportionate to their purpose. A freeze does not transfer ownership of your assets to us. Access, return or disposition of assets remains subject to law, valid claims, unsettled obligations and the custody arrangements described under Section 5.
15.4We may correct an erroneous ledger entry or duplicate credit after investigation, with an audit record and notice. We will provide a dispute route; we will not silently alter a completed balance without a documented basis.
15.5A restriction may apply to a transaction, asset, product, device, session or entire Account. We assess the least restrictive control reasonably capable of addressing the risk, subject to law and urgent protection needs.
15.6We may ask for identity, ownership, source-of-funds, transaction-purpose or security information. Failure to provide sufficient information can prolong review or lead to rejection or closure where we cannot lawfully or safely continue.
15.7We review an ongoing restriction and lift or narrow it when its basis no longer applies. We may be unable to disclose a protected report, investigation method or authority instruction.
15.8A compliance hold does not guarantee preservation of market value. Where lawful, you remain exposed to price changes in an asset while access is restricted.
16Service availability and third parties
16.1We aim to maintain the Services but cannot guarantee uninterrupted operation or that a particular market, network or payment rail will always be available. We will provide notices of planned maintenance and material incidents through the Platform and any available status page.
16.2Blockchain networks and properly disclosed banks, payment, custody or liquidity providers can fail or delay transactions. We remain responsible for the obligations we undertake in these Terms and cannot shift all Platform errors to an unnamed third party.
16.3Prices, charts and third-party data may be delayed or inaccurate. Order execution and settlement are determined by authoritative execution and ledger records, not a decorative chart or indicative display.
16.4Planned maintenance can make some functions unavailable and may affect open Orders or positions according to the applicable market rules. We provide notice where reasonably practicable and explain any action you should take.
16.5During an unplanned incident, we may pause deposits, withdrawals, trading or another function to contain harm and reconcile records. A Service is restored only after we determine it can operate with acceptable controls; interface availability alone is not proof of restoration.
16.6We select and monitor material providers using risk-based diligence, but cannot guarantee their uninterrupted performance or solvency. We identify their role where material to your transaction and remain accountable for obligations we expressly undertake.
16.7Events beyond reasonable control can delay performance, including network failure, cyberattack, natural disaster, war, government action or widespread infrastructure outage. We take reasonable steps to mitigate impact, preserve records and communicate material status.
17Errors, reconciliation and complaints
17.1If an Order, transfer, deposit, withdrawal or balance appears wrong, contact support@nevix.com promptly and provide the relevant order, operation or blockchain transaction ID. We will investigate against the authoritative order, execution, wallet and ledger records.
17.2We will acknowledge and investigate complaints under the Complaints Policy and applicable law. If an investigation needs more time, we will explain the delay where lawful. The Complaints Policy identifies escalation and available external routes.
17.3A UI success message does not override an uncommitted or failed transaction. If our systems show conflicting states, we will preserve records, determine the actual outcome and correct the customer-facing status and any resulting balance error.
17.4We maintain records for the period required by law and our published retention policy. We make order, Fill, fee, transfer and wallet histories available through your Account in a usable form, subject to security and legal restrictions.
17.5When you dispute a transaction, we may ask for the order or transfer reference, amount, asset, date and relevant evidence. We compare the instruction, execution, ledger and external-settlement records, explain the result as far as lawful, and record any correction. You can escalate unresolved matters to complaints@nevix.com.
18Privacy and communications
18.1The Privacy Policy explains the personal data we collect, purposes, legal bases, recipients, international transfers, retention, security and your rights. These Terms are not a substitute for that policy.
18.2We may send service, legal, transaction, security and account notices through the Platform, email, SMS or another verified channel. You must keep contact information current. We send marketing communications only where we have the consent or other lawful basis applicable in your location and provide an opt-out where required.
18.3We will not request your password or one-time code through unsolicited messages. If an anti-phishing code feature is available, it supplements but does not replace verification of the sender and destination.
18.4You are responsible for maintaining access to your registered communication channels and updating them securely. A notice sent to the latest verified channel is treated according to Section 26 and applicable law.
18.5We may record or retain support communications, instructions and confirmations for service, security, quality, complaint and legal purposes as described in the Privacy Policy. Do not disclose another person's personal data without authority.
18.6Marketing preferences do not prevent necessary security, account, transaction or legal messages. You can use the available unsubscribe or privacy controls for optional communications.
19Intellectual property
19.1We and our licensors own the Platform software, design, trademarks and content, except for user content and third-party materials. We grant you a limited, revocable right to access the Services while you comply with these Terms.
19.2You retain rights in content you provide. You grant us only the rights reasonably necessary to host, process, display and investigate it for the Services, subject to the Privacy Policy and law.
19.3You must not copy, sell, reverse engineer or misuse the Platform except to the extent allowed by mandatory law or an applicable open-source licence.
19.4Feedback you voluntarily provide may be used to improve the Services without payment, provided we do not disclose your personal data contrary to the Privacy Policy. Do not submit material you are not authorised to share.
19.5Third-party names, market data, software and content remain subject to their owners' rights and applicable licences. Their display does not imply endorsement or transfer of ownership.
20Risks and no advice
20.1Digital assets can lose value rapidly or completely. Additional risks include liquidity shortages, slippage, smart-contract defects, cyber incidents, loss of keys, forks, network congestion, stablecoin depegging, provider failure, liquidation, counterparty default and changes in law or tax treatment.
20.2We do not give personalised investment, legal or tax advice merely by displaying market data, educational material, rankings, research, AI output or product information. You must make your own decisions and seek independent advice where appropriate.
20.3A token's listing is not an endorsement or assurance about its legality, issuer, value or future performance. The Risk Disclosure provides additional information about high-risk products.
20.4You are responsible for assessing a transaction in light of your objectives, financial resources, knowledge and ability to bear loss. We do not monitor your portfolio to advise when to buy, sell, hold or close a position.
20.5Risk controls, eligibility checks, warnings and educational materials cannot identify every risk or make an unsuitable product suitable. Past performance, simulated results and annualised returns do not predict future outcomes.
20.6You acknowledge the risks applicable to a Service when using it, but this acknowledgement does not waive a mandatory right or excuse our failure to perform a non-excludable obligation.
21Liability
21.1Each party is responsible for loss caused by its breach of these Terms, negligence, fraud or unlawful conduct to the extent applicable law provides.
21.2We are not responsible for ordinary market losses arising solely from your validly executed trading decisions, or for a blockchain or external provider failure outside our reasonable control, except to the extent caused or worsened by our breach or negligence.
21.3To the extent the law permits, neither party is liable for remote or unforeseeable consequential loss. Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence where it cannot be excluded, personal injury, misappropriation of customer assets, or any right or remedy that applicable law makes non-excludable.
21.4We do not exclude responsibility for an incorrect debit, duplicate processing or other loss to the extent caused by our breach or negligence. Any remedy takes account of authoritative transaction records, causation, reasonable mitigation and mandatory law.
21.5We are not responsible for loss caused solely by inaccurate information or an unauthorised instruction you provide, failure to protect credentials, use of an unsupported network, or action of an independent third party outside our reasonable control, except where our breach or negligence contributed to the loss.
21.6You must take reasonable steps to limit an avoidable loss after becoming aware of an error, compromise or service issue, including notifying us promptly and not repeating an uncertain instruction. This does not remove a mandatory reimbursement right.
21.7No estimate, service target or indicative price creates a guarantee unless we expressly state it is binding. Completed execution and settlement records determine actual quantities, prices and fees, subject to correction under Section 17.
22Suspension, closure and termination
22.1You may request closure by writing to support@nevix.com from your registered email address. Before closure, open Orders, positions, disputes, holds and balances must be resolved according to the relevant product rules. We will explain any lawful reason why assets cannot yet be returned.
22.2We may suspend a Service or Account for the reasons in Section 15, or terminate for a serious or repeated breach, legal prohibition or discontinuation of a Service. We will give notice and an opportunity to remedy where lawful and reasonable.
22.3Termination does not erase completed transactions, accrued fees, disputes or record-keeping duties. We will provide a reasonable route to withdraw eligible remaining assets, subject to lawful holds and operational constraints.
22.4We may require cancellation or settlement of open Orders and positions before closure. If immediate termination is required for law or security, we handle remaining assets and obligations according to the applicable product rules and legal restrictions.
22.5Closure can be delayed by a negative balance, chargeback, unresolved P2P appeal, ownership dispute, authority request, security investigation or legally required retention. We explain the category of reason where lawful.
22.6After closure, access to the interface may end. You should download available statements beforehand; you may request retained transaction information through support or the privacy process, subject to verification and law.
22.7Reopening or creating a new Account after termination requires our approval and fresh eligibility checks. You must not evade a suspension by using another person or account.
23Changes to these Terms
23.1We may amend these Terms to reflect legal, security, product or operational changes. We will publish the new version and notify affected users before material changes take effect where reasonably practicable, unless immediate change is required by law, security or a competent authority. A revised version will state when it applies at publication.
23.2Where required by law, we will obtain express acceptance before a material change applies. If you do not accept the revised Terms, you may stop using the Services and request Account closure, subject to Section 22.
23.3We identify the version made available to you and preserve prior versions and acceptance records as reasonably needed. A change does not retroactively alter a completed transaction unless law or an agreed error correction requires it.
23.4Immediate changes may be necessary to comply with law, address fraud or security, protect market integrity or respond to an external network. We provide notice as soon as reasonably practicable where advance notice is not possible.
23.5Continued use after a validly notified change can constitute acceptance where applicable law permits. Where express acceptance is required, we will not rely only on continued use.
24Governing law and disputes
24.1These Terms are governed by the laws of Malaysia, except where mandatory law gives you rights that cannot be waived.
24.2Subject to any mandatory forum available to you, the courts of Kuala Lumpur, Malaysia may hear disputes arising from these Terms. This clause does not prevent a consumer from using a court, tribunal or regulator forum that mandatory law makes available, including rights under the Consumer Protection Act 1999 where it applies.
24.3We encourage you to use the complaint process first, but it does not prevent you from exercising a legal right to seek urgent relief.
24.4A dispute should identify the relevant Account, transaction, facts, requested remedy and earlier complaint reference. Each party will preserve relevant records and may seek to resolve the matter in good faith before court proceedings, without delaying a mandatory limitation period.
24.5The governing-law and forum provisions do not deprive you of protections that apply mandatorily based on your location or customer status. A competent court determines the enforceability and scope of these provisions.
25General
25.1If one provision is invalid, the rest remain effective to the extent they can operate fairly and lawfully.
25.2Failure to enforce a provision once is not a permanent waiver.
25.3You may not assign your Account or these Terms without our consent. We may transfer our rights or obligations as part of a lawful business transfer, with notice and appropriate protection for customer assets and data.
25.4These Terms and the applicable documents identified in Section 1.4 are the agreement for the Services. Nothing in them creates an investment-advisory, fiduciary or agency relationship unless a separate written agreement or applicable law says otherwise.
25.5The English version controls unless mandatory local law requires a different language. We will make important notices reasonably accessible.
25.6Events beyond reasonable control may delay performance, but we will take reasonable steps to mitigate the impact, safeguard records and communicate material service status.
25.7Headings and summaries assist navigation but do not replace the operative clauses. “Including” means including without limitation unless context requires otherwise, and singular terms can include the plural.
25.8If a translated version differs from the English version, the English version controls to the extent permitted by mandatory law. We may provide translated notices for convenience without creating a separate agreement.
25.9Rights and obligations intended by their nature to continue-including completed transactions, fees, intellectual property, records, disputes and applicable liability provisions-survive closure or termination.
25.10No person other than you and the identified contracting party obtains a right under these Terms merely because they are mentioned, unless applicable Product Terms or law expressly provide otherwise.
26Contact and legal notices
26.1Use the appropriate address above and include the relevant Account, Order, operation or transaction reference. Do not send passwords, private keys, seed phrases or one-time authentication codes.
26.2We may send notices to your registered email, through the Platform or another verified channel. You must keep contact information current and review security and transaction notices promptly.
26.3A notice is considered received according to applicable law and the delivery method. A failed delivery caused by outdated information does not invalidate a notice where law permits, but we will use reasonable alternative methods for a material matter where practicable.
26.4Security incidents should be reported immediately and are handled under the Cybersecurity and Cyber Law Policy. Formal complaints follow the Complaints Policy. A support conversation does not amend these Terms unless an authorised written agreement expressly says it does.
End of Terms and Conditions.
